CANADA IMMIGRATION AND
CRIMINAL INADMISSIBILITIES

The Immigration and Refugee Protection Act states that individuals with a criminal background are not admissible for Canada immigration. More specifically, “a foreign national is inadmissible on the ground of criminality for… committing an act outside Canada that is an offence in the place where it was committed and that if committed in Canada and would constitute an indictable offence under an act of parliament”.

This is Canada Immigration’s most general restriction and of course a more serious criminal infraction will bring to the inadmissibly of the individual for immigration to Canada.

The Immigration and Refugee Protection Act also states that, if the Canadian Immigration and Citizenship officer has reasonable ground to believe that the individual has been involved in acts of espionage, terrorism, crimes against humanity or war crimes, the individual will be inadmissible for immigration to Canada.

Canada immigration may consider some infractions as an “offence punishable on summary convictions” instead of an indictable offence as referred in the Immigration and Refugee Protection Act.
