Inadmissible to Canada - Rehabilitation

RSS has experienced a high volume of inquiries in regard to inadmissibility to Canada due to criminality issues. In order to maintain our high service standards we have initiated Rehabilitation services for clients who may require same.

The experienced professionals at RSS will research and provide an assessment in each particular case in order to successfully obtain rehabilitation as indicated in the process below.

Definition of Rehabilitation

Rehabilitation is granted and removes the grounds of inadmissibility to Canada if the individual concerned is deemed unlikely to be involved in any further criminal activity;

Individuals permitted to apply for Rehabilitation

Foreign nationals convicted of a criminal offence or who have committed a criminal act and 5 years have expired from the last day of the sentence;

An individual is deemed rehabilitated if:

. 10 years have expired from the last day of their sentence or the date of the offence;

. no conviction or imprisonnement has been completed since the prior offence;

. the offence was punishable in Canada for a term less than 10 years;

Individuals who have been convicted of 2 or more offences will be deemed rehabililtation if:

. 5 years have expired from the last day of their sentence;

. no conviction or imprisonnment has been completed since the prior offence;

Criminal Inadmissibility - Foreign nationals who have been convicted of a crime or committed a criminal offence may be permitted to enter Canada if:

. they satisfy a Canadian Immigration officer that the legal requirement has been met to be deemed rehabilitated or;

. a rehabilitation application has been filed with Citizenship and Immigration Canada and has been granted;

. a temporary work permit has been granted;

. a pardon has been granted by the National Parole Board of Canada if the criminal offence was committed in Canada or a foreign pardon recognized in Canada;

A foreign national may enter Canada if they committed a single indictable offence in Canada and obtained a pardon from the National Parole Board of Canada.
